Lawsuit filed against driver, bar, in deaths of Galveston locals

When the negligence or misconduct of someone results in the death of another, that death may be considered a wrongful death. The family of the victim of such negligence, perhaps leading to a fatal accident, can suddenly find itself saddled with unexpected final costs as well as the emotional pain of losing a loved one.

On Oct. 4, a wrongful death lawsuit was filed over the deaths of two Galveston men. The action stems from an April accident in which the two men, aged 42 and 43, were struck by a car driven by a 27-year-old man at Seawall Boulevard and 13th Street. Police reports at the time indicated that the car that struck the two men was headed west and had also struck a parked car. The driver of the car was charged with two counts of intoxication manslaughter after the incident. The status of the criminal case isn't apparent from the reports we've seen.

The wrongful death lawsuit was filed on behalf of the relatives of one of the accident victims and also includes accusations leveled at a local bar. The bar is alleged to have sold drinks to the 27-year-old driver prior to the accident even though the man was supposedly visibly inebriated. The level of damages sought isn't specified in the suit documents.

The families of victims of fatal car accidents need to be aware of their legal rights and options. A wrongful death lawsuit is one option available for seeking compensation. While financial compensation can't ease the emotional pain of losing a loved one, it does offer a means to alleviate the sudden financial burdens of an unexpected loss as well as to compensate survivors for what Texas law calls the loss of companionship and society.
