Galveston bar named as defendant in wrongful death suit

A fatal accident may have many causes such as intoxication, recklessness and excessive speed. The family members of a loved one who has died in such an accident may be entitled to compensation through a wrongful death suit. The following case involves a suit that claims alcohol was a factor in a fatal car crash.

The accident occurred in Galveston on Nov. 5, 2012, according to court documents that were filed in Galveston County District Court on Feb. 13. The suit states that the decedent visited the Lucky Lounge, located on the west end of Galveston. The lawsuit also claims that the bar served an excessive amount of alcohol to the decedent, even though he was obviously intoxicated.

The family of the deceased man claims that he left the bar at around 4:14 a.m. in a 2000 Jeep Wrangler, after the bar failed to call a taxi or the police. The decedent attempted to turn right and lost control of his vehicle. He was thrown from the vehicle, which then ran over him.

The crux of the wrongful death suit is that the defendant's imprudent driving was directly caused by his severe intoxication. The plaintiffs in this case have requested a jury trial.

Texas law allows family members to collect damages for the monetary losses due to a wrongful death. The pain and suffering, loss of companionship, and funeral expenses of the survivors may result in additional compensation.
