2 dead, 1 injured in fatal Texas crash

According to a trooper with the Texas Department of Public Safety, the driver allegedly responsible for a fatal car crash on May 8 had been prescribed medication for an injury. The accident took place on Texas 173 in Bandera.

A female motorist followed the accused truck driver as he swerved in and out of lanes for several miles while her passenger contacted a 911 dispatcher. Before the authorities arrived, however, the driver crossed into the oncoming traffic lanes and collided with a vehicle driven by a young woman.

An 18-year-old passenger died as a result of the injuries he suffered. The 19-year-old female driver was transported to a nearby hospital for treatment of multiple fractured bones. She was reported to be in stable condition. The 50-year-old truck driver did not survive the accident. While authorities discovered that the man had recently obtained prescription drugs for a work-related head injury, they were still waiting on the results of an autopsy to determine if the driver was under the influence of that medication when the crash occurred.

Drivers can be charged with driving while intoxicated even if they have a prescription for the medication that they took prior to causing a car or truck accident. In the event that a victim dies in an accident, their family may wish to file awrongful death claim against the negligent driver. In cases where the driver dies, as in this situation, the family may still be eligible to file the claim against their estate.
