Pedestrian killed by pickup truck near Galveston seawall

Authorities in Texas have reported that one person was killed and another seriously injured on June 8 after a pickup truck lost control near the Galveston seawall. The two people were standing outside of a souvenir store on Seawall Boulevard when they were struck. The driver of the pickup truck also suffered minor injuries. The pedestrian accident occurred at about 7:00 a.m.

Witnesses told police that the pickup truck struck the two pedestrians after making a right turn onto the street. The truck is said to have picked up speed as it crossed five lanes of traffic before striking the two pedestrians. The driver then continued over the seawall and onto the sand. A 62-year-old man was pronounced dead at the scene and a 48-year-old man was taken to a nearby hospital with serious injuries. He was later reported to be in stable condition.

The 49-year-old driver of the pickup truck was taken into custody after receiving medical treatment. He has been charged with aggravated assault and manslaughter. His bond has been set at $750,000. Police say that drug or alcohol use has not been ruled out, and they are awaiting the results of a toxicology test. The man was on probation for a drug charge at the time of the accident.

While alcohol use or reckless driving may be significant factors in this driver's criminal trial, they may not be relevant in a wrongful death suit brought by a personal injury attorney on behalf of the family of the deceased individual. Plaintiffs in a civil case must prove that the defendant's negligent actions caused them injury, loss or damage in order to obtain compensation.
