Full accident recovery depends on knowing all possible sources

Imagine you have suffered a serious injury in a motor vehicle accident. You survive, but you lose a limb. Your life is forever changed and it may well be that your income earning potential will suffer greatly. Do you know all the avenues that may be open to you for seeking compensation for the damage, pain and suffering you have endured and may well have to deal with into the future?

You might think it is as simple as filing an insurance claim. Maybe it will involve several claims. But any one of them could be denied and if that happens, it could mean that your standard of living could be drastically eroded. That's not something the innocent victim of a car accident should have to face. To seek the fullest measure of recovery and feel confident that you have done all you can to protect your rights, consulting an experienced attorney is always advised.

The recent case of a Texas woman who lost part of her leg in a car accident serves as something of an example. The 73-year-old victim was on her way home from a work meeting earlier this summer when she was involved in a head-on collision. In addition to losing her limb, she suffered multiple fractures.

When she filed a claim for workers' compensation, her employer's insurance company denied it. That meant no temporary income benefits and no coverage for the reasonable costs of necessary medical car as might be expected. She feared she might have to sell her house as a result.

The reason given for the denial was that the woman was not technically "on the job" at the time of the crash. In a rare move, the Texas Division of Workers' Compensation ordered the insurer to start paying benefits immediately.

Her attorney says that shows the denial was absurd to begin with, but the insurer says it had to deny the claim to protect its claim for reimbursement from its excess insurance provider.

You can see that there can be layer upon layer of insurers that need to be dealt with in any given crash scenario. That's too great a burden to deal with when you are trying to simply recover and get on with your life. This is where an experienced attorney can help.
